BANKRUPTCY FEES & COSTS

 

HOW MUCH DOES IT COST TO FILE BANKRUPTCY?

 

  • Most of the cases I file are Chapter 7 bankruptcy cases. About 98% of the Chapter 7 cases I file are charged as a flat fee. I also file Chapter 13 bankruptcy cases for my clients. Typically, most attorneys charge the same flat fee for Chapter 13 cases, however, each attorney may request a different "up front" fee prior to filing your case. Some attorneys charge by the hour. The remainder of my flat fee is paid from monthly payments. Below I have listed the anticipated fees and costs for both Chapter 7 and Chapter 13 bankruptcy cases.

 

ATTORNEY FEES:

 

  • Chapter 7 Bankruptcy Flat Fee - *$600.00 to 900.00 for single filers / *$700 to 950.00 for married filers. (Prices include the cost of the Bankruptcy Credit Reports listed below). *Attorney fees may be lower or higher dependent upon your individual circumstances. A flat fee quote will be given to you during your free consultation

 

  • Chapter 13 Bankruptcy Flat Fee - $4,000.00 for single filers and married filers. An $800.00 retainer must be paid prior to filing your case, and the balance of the Chapter 13 flat fee ($3,200.00) can be paid through a 3 to 5 year payment plan to creditors. 

 

COURT FILING FEES:

 

  • Chapter 7 Filing Fee - $335.00 (Your filing fee may be paid in four installments. The first installment of at least $75.00 must be paid at the second appointment and will be paid to the court at filing. 

 

  • Chapter 13 Filing Fee - $310.00 (Must be paid before filing).

 

BANKRUPTCY CREDIT REPORT FEES:

 

  • Individual Report - $25.00 (included in the Chapter 7 fee for single filers as noted above).

  • Joint Report (married couple) - $50.00 (included in the Chapter 7 fee for married filers as noted above).
